When your skin is parched, you quench its thirst by slathering on a thick, hydrating lotion/balm. So when your strands miss moisture like the deserts miss the rain, the same logic applies. Vitaminwater vs. Vitaminshampoo

They say that the human body is 65 percent water. In my case, make that 65 percent vitaminwater…the multi-v/lemonade variety, specifically. It’s my drink of choice. So imagine my excitement when I’m flipping through the October issue of Allure Magazine and come across an advert for vitaminshampoo. “Think of it as an energy drink for your hair,” says the tagline.

So Glacéau makes shampoo now? Hells yeah, right? Wrong. After my initial excitement (and an impromptu happy dance), I did a little research into this new line of hair care products and discovered that despite the name, similar packaging and the label’s indistinguishable typography, vitaminshampoo is not affiliated with Glacéau. Rather, these shampoos and conditioners are products of Vogue International. And to say that Glacéau isn’t happy about it would be a gross understatement.

According to Managing Intellectual Property, Glacéau recently secured a temporary restraining order against Vogue International, alleging trade dress infringement, false designation of origin, trade dress dilution, deceptive acts and practices and unfair competition. Counsel for Vogue International argued that because vitaminwater and vitaminshampoo are different classes of goods, there can be “no likelihood of confusion.”

Judge Lewis Kaplan, however, disagreed. “There are earmarks of bad faith all over the place,” he said. “It is inconceivable to me that the defendant could possibly have developed this trade dress that the defendant is using without an attempt to go at least as close to the line as it thought it could get and, in all likelihood, well over the line of imitating the plaintiff’s.”

noni berry Vitaminwater vs. Vitaminshampoo“Looking at the array of the defendant’s bottles next to the array of the plaintiff’s bottles with colored liquid in them, it seems reasonably clear that any normal consumer would be confused, the impression would be that the products are from the same source,” Judge Kaplan continued.

Vogue International’s first order of business, since the temporary restraining order was granted, has been the tweaking of vitaminshampoo’s label. Compare the old label (above) to the new label (left), as seen on the vitaminshampoo website.

The temporary restraining order has been extended through the end of the year and negotiations between Glacéau and Vogue International are underway…though this legal tug-of-war is far from (vitamin)water under the bridge.

Since its August debut, I haven’t missed an episode. And I don’t have TiVo or DVR or any of that new-fangled technology, which attests to the addictive nature of The Dish.

Recently, I had the opportunity to interview the show’s saucy host, Danielle Fishel. Danielle is best known for her role as Topanga on Boy Meets World. But after watching one eppy of The Dish, you’ll be so impressed by this snarkstress’ sass and comic timing, the farthest thing from your mind will be Topanga’s saccharinely sweet romance with one Cory Matthews.

SP: If I opened up your handbag right now, what beauty products would I find inside?
DF: 42 types of lip balm! My favorite is Victoria’s Secret called “Balmy Night” because its really moisturizing. I also love Bobbi Brown for some color and MAC Plushglass. I dont need the plumping effect per se, but I love the tingling sensation and it doesnt ever leave that white film in the corners of your mouth! YUCK!

SP: What is your signature scent?
DF: I can’t really say that I have a signature scent because I LOVE perfume and have a large glass tray with over 30 kinds of perfume, ranging from clean to sweet to spicy. Sometimes I wear a different one every day of the week and other times, I stick with one for days on end. Some regular favorites are the original Bvlgari Omnia, Tiffany, and Juicy Couture.

SP: You’ve grown up on television, so surely you must have picked up afew makeup tricks/secrets. Care to share?
DF: No. Just kidding…I think my favorite trick is to do your eye makeup first, especially when doing a smoky eye, so that any loose powder that falls on your cheeks can be washed off without ruining the work you’ve done with your foundation!

SP: Danielle, you have shampoo commercial hair…I need to know what hair products you use.

I have never stuck with one product for very long although if you must know my longest lasting favorite it was whatever shampoo was on sale combined with Suave Go-Go Grape Children’s Conditioner!!! It has a detangler in it and smells delicious! L’Oreal Kids also makes a grape conditioner with a detangler but it doesn’t have a cool name like Go-Go Grape. icon smile Danielle Fishel Dishes On Her Shampoo Commercial Hair: Grape Children’s Conditioner? Outside of that, I do not use any products. I hate hairspray and serums and all of that. It just makes my hair feel heavy and weighed-down. I wash my hair and blow dry it with a metal round brush (I only wash and dry my hair once every 4-5 days which is why it is still healthy, but I’m lucky that I dont get greasy hair!) and then I go. I usually don’t even brush it again until it’s time to wash it.
